Welcome to WOWCHAT. These Terms & Conditions ("Terms") govern your access to and use of the WOWCHAT mobile application and related services (the "Service"), operated by WowChat World ("we," "us," "our"). By creating an account or using WOWCHAT, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
01 Eligibility
You must be at least 13 years old (or the minimum age required in your country to consent to use of online services without parental approval) to create a WOWCHAT account. If you are a minor under applicable law, you may only use WOWCHAT with the consent and involvement of a parent or legal guardian, including through our Parental Guardian features where applicable.
02 Your Account
You must provide a valid phone number to create an account, which is used for verification and account security.
You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it.
You agree to notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
03 Description of the Service
WOWCHAT provides:
Chats — one-on-one and group messaging, voice and video calls, voice notes, and disappearing Stories
Origin — a social feed for posts, photos, videos, Reels, Events, Groups, and hashtag discovery
Marketplace — a platform to buy, sell, and discover listings from other users
Channels — content and updates from creators and businesses, including catalogs and live streams
Live streaming — the ability to broadcast to followers or view others' broadcasts
The WOW Signal — an interactive puzzle/community feature
WOWCHAT Pro — an optional paid subscription unlocking additional features and a verified badge
Parental Controls — tools for parents/guardians to manage a minor's experience on the platform
We may add, modify, or remove features at any time without prior notice.
04 User Conduct
You agree not to use WOWCHAT to:
Post or share content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or invasive of another's privacy
Impersonate any person or entity, or misrepresent your affiliation with any person or entity
Upload or transmit viruses, malware, or any other malicious code
Attempt to gain unauthorized access to the Service, other users' accounts, or our systems
Use the Service for any fraudulent, deceptive, or illegal purpose, including scams on Marketplace
Harvest or collect information about other users without their consent
Violate any applicable local, national, or international law
We reserve the right to remove content and suspend or terminate accounts that violate these standards, at our discretion.
05 User Content
Ownership. You retain ownership of any content you create and share on WOWCHAT ("User Content").
License to us. By posting User Content, you grant WOWCHAT a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display that content solely for the purpose of operating and providing the Service to you and other users as intended (e.g., displaying your posts to your followers, delivering your messages to their recipients).
Your responsibility. You are solely responsible for the content you post and for ensuring you have the right to share it. Do not post content that infringes on the intellectual property or other rights of any third party.
Removal. We may remove any User Content that violates these Terms or that we determine, in our sole discretion, is inappropriate, without prior notice.
06 Marketplace
Marketplace is a platform that facilitates listings between users. WOWCHAT is not a party to any transaction between buyers and sellers and does not guarantee the quality, safety, legality, or accuracy of any listing.
Users are solely responsible for complying with applicable laws regarding the sale of goods, including any required permits, age restrictions, or prohibited items.
We recommend meeting in safe, public locations and inspecting items before completing any transaction. WOWCHAT is not responsible for disputes, damages, or losses arising from Marketplace transactions.
07 Live Streaming and Calling
Live streams and calls are provided using third-party real-time communication infrastructure. While we take reasonable measures to protect these features, we cannot guarantee uninterrupted or error-free service.
You are responsible for the content you broadcast during a live stream and must comply with the same content standards outlined in Section 4.
08 WOWCHAT Pro (Subscription)
WOWCHAT Pro is an optional paid subscription that unlocks additional features.
Subscription pricing, billing terms, and cancellation policies will be presented to you at the time of purchase and are subject to the terms of the app store platform (Google Play) through which the subscription is purchased.
We reserve the right to change Pro features or pricing with reasonable notice.
09 Advertising
WOWCHAT displays advertisements from third-party businesses within the Service. We are not responsible for the content, accuracy, or claims made in third-party advertisements, or for any transactions between you and an advertiser.
10 Parental Controls
Parents or legal guardians using our Parental Guardian features are responsible for the accuracy of the information they provide and for appropriately supervising the linked minor's account. WOWCHAT provides these tools in good faith but cannot guarantee they will prevent all forms of inappropriate content or contact.
11 Termination
You may delete your account at any time through the app. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms or for any other reason at our discretion, including to protect the safety of our community.
12 Disclaimers
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free.
13 Limitation of Liability
To the maximum extent permitted by applicable law, WOWCHAT and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of, or inability to use, the Service.
14 Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the app or other reasonable means before the changes take effect. Continued use of WOWCHAT after changes take effect constitutes your acceptance of the revised Terms.
15 Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law principles, unless otherwise required by applicable law in your jurisdiction.
